MEGA/LEGO row: Mega spokesman boasts confidence

Mega Brands says it is confident it will prevail over Lego in European patent dispute.

Mega Brands has stepped up its argument against Lego as the two sides dispute the 2006 EU trademark agency ruling that the Lego brick can’t be legally protected because its space is decorative, not functional

A spokesman for Mega Brands said the company has prevailed in some 15 similar cases that have been launched by Lego around the world, including a case in Canada.

Harold Chizick said: “We have been court with them all over the world in many countries and we have no reason to believe that the decision will be overturned.”

Analyst and ToyNews contributor, Lutz Muller, said the ruling is important to both firms, but a loss by Mega Brands could be more serious, undermining its value as a takeover target by limiting the potential to expand sales into the European Market.
