Lawsuit is off the planet, says Mattel

Mattel believes the current copyright lawsuit in the US over its Planet Heroes toys should be dismissed.

Filed in the US in September by Joesph Ottis, the lawsuit claims the firm stole his ideas for a range of characters, and is consequently selling them as the Planet Heroes line.

In Mattel’s response, which it filed this week, it believed concepts can’t be copyrighted. It also argued Ottis’ stories about heroes with special powers associated with planets isn’t very original.

The firm described Ottis as a “man with a colourful past, a questionable business history and an active imagination” and that “on both the facts and the law, Mr. Ottis' claim of copyright infringement is without merit.'
