Australian toymaker, Moose Enterprises is taking a zero tolerance stance on the sale of counterfeit Shopkins toys in the US.

As part of its crackdown, the firm has now executed seizure orders on US retailers found to be selling fake Shopkins products.

The latest haul follows the recent investigation and raids in China on factories found to be manufacturing and selling counterfeit Shopkins toys.

Intellectual property lawyers for Moose Enterprises obtained an order from the US District Court for the Eastern District of New York permitting it to seize counterfeit goods and business records as well as imposing a temporary restraining order against the businesses from making further sales.

The organisations in question have since agreed to a preliminary injunction while the parties involved discuss settlement.

“Moose has a zero tolerance policy; we take intellectual property infringement very seriously and we will prosecute offenders to the fullest extent of the law,” said Manny Stul, Co-CEO of Moose Enterprise.

Moose Enterprise has since stated that it will ‘aggressively pursue’ any business, from manufacturer through to retailer, found to be dealing with counterfeit Moose Enterprise branded products, ‘with every legal means necessary.’

“Moose Enterprise will spare no expense in vigorously protecting its brands and its customers’ right to ensure they are purchasing genuine, safe products,” said Stul.

The TIA’s SVP of technical affairs, Al Kaufman, added: “Counterfeit toys, in addition to depriving the owner of the legitimate item sales revenue to which they are entitled, may also present a potential safety risk.

“It should not be surprising that a manufacturer who violates the law by producing counterfeit goods may also be unconcerned with safety compliance, so counterfeit goods may not undergo the same rigorous testing that is required of legitimate goods.

“This is why it is important to buy only reputable brands from retailers you know and trust.”
